Terms of Service
Please read these terms carefully before using our services or placing orders for manufacturing.
01. Acceptance of Terms
Welcome to SZJQ PACK. By accessing our website, requesting quotes, or placing orders for our metal packaging products (including tinplate barrels, steel drums, and custom containers), you agree to be bound by these Terms of Service.
These terms constitute a legally binding agreement between you ("Client", "Buyer") and SZJQ PACK ("Manufacturer", "We", "Us"). If you are entering into this agreement on behalf of a company, you represent that you have the authority to bind such entity to these terms.
02. Products & Specifications
Note on Industrial Tolerances: As an industrial manufacturer, all metal packaging products are subject to standard industry tolerances regarding dimensions, weight, and volume capacities unless specifically agreed otherwise in a written technical drawing.
- Customization: For OEM/ODM projects, the Client is responsible for reviewing and approving all proofs, prototypes, and technical drawings before mass production begins.
- Material Suitability: While we provide food-grade and industrial-grade options, the Client is ultimately responsible for determining the compatibility of the packaging with their specific product (e.g., chemical reaction with tinplate or coatings).
- Printing Colors: Due to the nature of printing on metal, slight color variations from paper proofs or digital screens may occur. We adhere to standard CMYK or Pantone matching within acceptable industrial limits.
03. Orders & Payment
All orders are subject to acceptance by SZJQ PACK. A purchase order is considered confirmed only upon issuance of a Proforma Invoice (PI) or Sales Contract signed by authorized representatives.
Minimum Order Quantity (MOQ)
MOQ varies by product type (e.g., printed vs. plain). Orders below MOQ may be subject to surcharges or rejected at our discretion.
Payment Terms
Unless otherwise agreed, standard terms are 30% deposit via T/T upon order confirmation, and the remaining 70% balance before shipment.
04. Shipping & Delivery
We ship worldwide from our facility in Suzhou, China. Delivery terms are generally governed by Incoterms® 2020 (e.g., EXW, FOB, CIF).
- Lead Time: Estimated production times are provided for reference only and commence after deposit receipt and artwork approval. We are not liable for delays caused by force majeure, customs, or shipping carriers.
- Risk of Loss: Risk of loss or damage to goods passes to the Client upon delivery to the carrier (FOB) or as defined by the specific Incoterm agreed upon in the Sales Contract.
- Inspection: Clients must inspect goods within 7 days of receipt. Claims for visible defects or quantity discrepancies must be made in writing within this period.
05. Intellectual Property
Client IP: The Client warrants that they own or have the right to use all trademarks, logos, and designs submitted to SZJQ PACK for printing ("Client IP"). The Client agrees to indemnify and hold SZJQ PACK harmless against any third-party claims regarding IP infringement.
Manufacturer IP: Any molds, tooling, or proprietary manufacturing processes developed by SZJQ PACK remain our property unless a separate tooling transfer agreement is signed and paid for by the Client.
06. Limitation of Liability
SZJQ PACK warrants that products will conform to the agreed specifications. Our liability for any defective product is strictly limited to the replacement of the defective goods or a refund of the purchase price for those specific goods.
IN NO EVENT SHALL SZJQ PACK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF PRODUCTION, OR DAMAGE TO CONTENTS STORED IN THE CONTAINERS.
